Chef Registration

Registration Requirements

• To register as a Chef on the Platform or Marketplace, you must be at least 18 years old.
• Provide accurate, complete, and truthful information, including your full name, email address, phone number, and professional background.
• Verify your email address and phone number.
• Provide proof of qualifications, certifications, or professional experience (e.g., culinary diploma, professional references, portfolio).
• Provide proof of address (e.g., Aadhar Card).
• Undergo any identity verification and background screening required by The Walk-In Chef or applicable law.
• Accept these Chef Terms and agree to maintain compliance with all applicable laws and regulations.

Booking Acceptance and Commitment

• Before accepting a booking, you must carefully review all details, including the date, location, guest count, menu requirements, service duration, agreed remuneration, and special instructions.
• Once you accept and confirm a booking, you are contractually expected to attend the client's premises at the agreed date and time and fulfil the booking as confirmed.
• Failure to Arrive and Penalty: If you fail to arrive at the client's premises at the agreed reporting time, without prior approval or a valid emergency, you shall be liable to pay a penalty equivalent to 100% of the total booking amount to The Walk-In Chef, subject to applicable law and the agreed booking terms.
• If you anticipate any delay or are unable to attend, you must immediately inform The Walk-In Chef and provide the reason. Informing the platform does not automatically waive the penalty; any waiver or reduction will be assessed based on the circumstances.
• In cases involving genuine emergencies, medical emergencies, or circumstances beyond your reasonable control, The Walk-In Chef may review the circumstances and determine an appropriate outcome in accordance with the applicable booking policy and law.
• Repeated unjustified cancellations, late arrivals, or failure to attend confirmed bookings may result in warnings, suspension of booking privileges, or termination of your account, in addition to any lawful contractual remedies.

Profile Accuracy and Professional Representation

• You are responsible for ensuring that your profile, photographs, qualifications, experience, menus, specialisations, availability, and pricing are accurate.
• You must not misrepresent your culinary expertise, certifications, employment history, or professional references.
• You may use the platform only for legitimate professional purposes.
• The Walk-In Chef may request supporting documents, correct inaccurate information, or remove content that violates its policies or applicable law.

No Unauthorised Private Bookings

• If you are introduced to a client through The Walk-In Chef, you must not knowingly arrange or accept a private booking with that client for the purpose of bypassing the platform's booking process, avoiding applicable platform fees, or circumventing agreed commercial terms.
• You must not solicit, encourage, or induce a client to book your services privately to avoid The Walk-In Chef's applicable booking procedures or commercial arrangements.
• Subsequent engagements arising from a platform-facilitated introduction must be processed through The Walk-In Chef unless the Company provides prior written permission otherwise.
• A breach may result in suspension or termination of platform access and other remedies available under applicable law. Any claim for compensation must be based on an enforceable contractual obligation and legally recoverable loss.

Professional Conduct and Client Safety

You must maintain professional behaviour and respect the privacy, safety, property, and personal boundaries of clients and their household members.

You must not engage in:

• Harassment, intimidation, threats, discrimination, or abusive behaviour.
• Unwanted physical contact, sexual harassment, or other inappropriate conduct.
• Theft, fraud, deliberate property damage, or unauthorised use of client belongings.
• Unauthorised photography, audio or video recording, or disclosure of client information.
• Consumption of alcohol or intoxicating substances that impairs your ability to perform the service safely.
• Any unlawful activity or conduct that places a client, household member, colleague, or other person at risk.

You must follow reasonable, lawful service instructions and immediately raise any safety concern with the client and The Walk-In Chef.

Serious allegations may result in interim suspension while the matter is reviewed. Final action will depend on the available information, the circumstances, applicable law, and the Company's policies.

Client Privacy and Confidentiality

• Client names, contact details, addresses, household information, booking details, access instructions, and personal conversations must be treated as confidential.
• You must use client information only to fulfil an authorised booking or comply with a lawful obligation.
• You must not share, sell, copy, retain unnecessarily, or use client information for unauthorised marketing or personal purposes.
• You must not publish photographs, videos, testimonials, or details of a client's home or event without appropriate permission.
• These obligations continue after a booking ends and after your account is deactivated, subject to applicable law.

Security

The security of your Personal Information is important to us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.

Acceptance Of The Terms And Conditions

• The User undertakes to be bound by the Agreement each time the User accesses the Site, completes the registration process.
• The User represents and warrants that they are 18 years of age or older and possess the legal capacity to enter into and perform obligations under this Agreement. Users below the age of 18 may access the platform only with the involvement, supervision, and consent of a parent or legal guardian. The Company shall not be obligated to verify the age of any User.

Pricing

• The Company does not guarantee or warrant the credentials, authenticity, or intent of any client, individual, or organization accessing the platform or contacting users.
• The Walk-In Chef by S&J Kitchen Curators and Services LLP would not be held liable for loss of any data technical or otherwise, and particulars supplied by subscribers due to reasons beyond its control like corruption of data or delay or failure to perform as a result of any causes or conditions that are beyond S&J Kitchen Curators and Services LLP reasonable control including but not limited to strikes, riots, civil unrest, Govt. policies, tampering of data by unauthorized persons like hackers, war and natural calamities.
• Chefs are advised to independently verify all client details before confirming any engagement. The Company shall not be responsible or liable for any discrepancies, disputes, or violations arising from such interactions.

Client

• The Walk-In Chef by S&J Kitchen Curators and Services LLP provides information and facilitates connections to the best of its ability. While reasonable efforts are made to ensure quality, the Company shall not be held liable for any inaccuracies or outcomes arising from information received. Clients are encouraged to review and confirm details before finalizing any engagement.
• We will make best efforts to use the parameters provided by client to short list, but take no responsibility for the accuracy of the short listing based on parameters for selection as specified by the client/subscriber.
• Client should verify cook and all related details before finalizing deal. We are not liable and responsible in case of any discrepancies/violations.

The Company shall not be responsible for any loss, damage, or injury arising from the use of client-provided equipment or infrastructure.

8. Service Hours and Overtime Charges

• The standard duration of each booking is up to five hours unless otherwise agreed upon in writing at the time of booking.
• If the service extends beyond the allotted duration, the client will be charged ₹200 for every additional hour.
• Any extension will be subject to the availability and consent of the assigned chef. The Company is not obligated to provide service beyond the agreed duration.

9. Indemnity

You agree to indemnify, defend, and hold harmless S&J Kitchen Curators and Services LLP, including its unit The Walk-In Chef, its partners, directors, employees, agents, and licensors, from and against any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to your use of the platform or any related services.
